Types of Child Custody in Massachusetts

Labels for child custody are becoming less of a focus in Massachusetts family courts. "Parenting plans" that outline the rights and responsibilities of parents are now the standard. At The Massachusetts Family Law Group, we closely follow evolving trends and changing laws that pertain to our clients.

Boston Child Custody Attorneys

We know that judges do not want to make child custody decisions based solely on financial motivations. While traditionally, labels such as legal custody, physical custody, sole custody and shared or joint custody were used to describe a parent's rights, today, it is more important to create a balanced parenting plan in which both parents participate in a child's life, if possible.

What Is a Parenting Plan?

A parenting plan is an agreement that outlines parenting arrangements for a child or children. Parenting plans are used both by divorced parents and by those who were never married. Parenting plans typically outline the following aspects of a child's custody and visitation:

  • Where the children will live
  • Who has the children on which days
  • Who makes major decisions regarding education, health care, extracurricular activities and other aspects of a child's life
  • What will happen if one parent's situation changes

Family courts encourage parents to create and mutually agree to parenting plans, instead of leaving it up to a judge to decide. When parents work together, they are more likely to follow the parenting plan and avoid conflicts that can affect the children.
